| Warranty Seller will deliver to Buyer the poultry described in this agreement in good condition so far as can reasonably be determined at the time of the delivery by Seller who has exercised flock control, egg selection, production and handling methods recommended and approved by the industry. Seller and Buyer recognize that there are certain factors which may materially effect the health or value of poultry, the extent or presence of which are unascertainable at the time of delivery. THEREFORE, IT IS UNDERSTOOD, AGREED AND CONSIDERED REASONABLE THAT THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE POULTRY OTHER THAN THOSE SPECIFICALLY STATED IN THIS AGREEMENT AND SELLER SPECIFICALLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OF THE POULTRY AND ANY WARRANTY OF FITNESS OF THE POULTRY FOR ANY PURPOSE OR OF THE SUITABILITY OF THEM FOR ANY USE. WE DO NOT GUARANTEE THE HEALTH OR LIVE SPAN OF ANY POULTRY. |
